Terms of Use

Introduction:

The Centre Pompidou offers free access to users of its website and online data. The website is intended to be used under normal browsing conditions. Its design has been subject to rigorous tests to ensure it adapts to the greatest number of possible configurations, without damaging the IT infrastructure.

Use of the website is nevertheless subject to the conditions stated below in order to ensure quality for everyone. Every user utilising the website platform, fully or partially, with or without a personal account, is subject to these Terms of Use. These supplement current national and international laws, particularly those relating to the intellectual property rights of elements presented or produced in the context of the Centre Pompidou’s digital environment.

The website and its contents:
The Centre Pompidou provides a website under free licence. The use of elements of the website is subject to this specific licence, in agreement with the Centre Pompidou and the teams which developed the element in question.

The website and its features may be momentarily unavailable; the Centre Pompidou is committed to re-establishing the service as quickly as possible. Likewise, the Centre Pompidou may make any alteration to the service, its content and/or its conditions of access, without advance notice, notification or reparation.

The Centre Pompidou may in no event be held responsible for the consequences resulting from any modification, discontinuity or deletion of the service, on any grounds and particularly due to technical constraints.

The term “digital content” refers to the entire original or reproduced content on the website, including fixed or animated images, texts and publications or parts of publications, and sound files (recordings of lectures, interviews, musical works or parts thereof, sound installations, etc.).

The Centre Pompidou provides digital content to internet users, the use of which is protected by current laws. Their re-use by the internet user is subject to prior request directly from the rights holders. In the absence of authorisation, any reproduction or representation, total or partial, and any use, adaptation, provision or modification of these elements is strictly forbidden and constitutes an infringement of copyright as according to the code of intellectual property.

All credits for digital content are provided to internet users on the web page on which the content is displayed. The Centre Pompidou undertakes to verify the accuracy of the information it provides to internet users. In the event that this information contains inaccuracies or errors, it undertakes to make every endeavour to rectify the information as quickly as possible.

The brands belonging to the Centre Pompidou and its partners and the logos appearing on the website are trademarks registered with the INPI and are, as such, protected by industrial property law. Any total or partial reproduction of these brands and/or these logos made from the elements of the website without express authorisation from their owners is strictly forbidden and constitutes an infringement of copyright as according to the code of intellectual property.

The information and programming content of this site is public administrative information in the sense of article 10 of law n° 78-753 of 17 July 1978. Any re-use of this information is free, on condition that it is not altered, that its sense is not misrepresented and that its sources and the date of its last update is mentioned. Ownership of public administrative information cannot be transferred to the re-user. The latter has a personal and non-exclusive right of re-use of this public administrative information. Any person re-using public information in violation of the above-mentioned provisions may be fined by the Commission d'Accès aux Documents Administratifs (Commission for Access to Administrative Documents).

Personal Data

The internet user and personal data:

The Centre Pompidou’s website is able to share and store data derived from the use of its web service on the internet user’s computer (cookies) and on the servers belonging to the Centre Pompidou. This data is only used for the purposes of the service requested by the internet user during browsing and is only retained to ensure the proper functioning of the requested service.

Any data produced by the internet user and sent to the Centre Pompidou via its website or digital exchange platforms may be stored. As the internet user, you have a right to access, correct, modify and block the data which concerns you or concerns deceased persons of whom you are the legal successor, free of charge, pursuant to articles 38, 39 and 40 of the law n° 78-17 of 6 January 1978 relating to information technology, files and civil liberties.

Interaction between the Centre Pompidou and internet users:

The Centre Pompidou provides features on its website for use by internet users. The internet user is invited to make use of these features within the framework of current legislation. The features put in place by the Centre Pompidou aim to raise awareness of contemporary art and culture, but any new use intended by internet users and respecting the contents and rights relating to these may be suggested to the Centre Pompidou through its digital platforms. The Centre Pompidou reserves the right to accept or refuse, stating the reasons for refusal. This refusal may take the form of the closure of a personal account or the implementation of technical measures preventing access to its services.

These features allow internet users to acquire content made available via its resource centre, by bookmarking it or highlighting it on social networks or in emails to contacts. These exchanges are carried out via resource URLs, without ownership being transferred. These features are available via the platforms set up by the Centre Pompidou and it is up to the internet user to protect access to the personal data which enables the use of the services to which the user specifically subscribes.

Other features may be put in place as part of the development of the website. These will respect the Centre Pompidou’s commitments described in these Terms of Use; the internet user will be subject to the same Terms of Use. Any modification of these general Terms of Use is assumed to be accepted by the user. The latter may consult these general Terms of Use at any time in this section.

Some features require the identification of the internet user. This must be completed accurately and honestly by the internet user and grants the right to a non-assignable licence of use. Any feature involving the personal data of internet users will be made secure and will be clearly signalled to the internet user.

Management of this personal data by the Centre Pompidou is carried out according to current law, after declaration to the CNIL of potential data files, and in respect of the provisions of law n°78-17 amended as of 7 January 1978 relating to information technology, files and civil liberties. Pursuant to this law, the user has the right of access, amendment and deletion, in relation to the Centre Pompidou’s services indicated on the registration form for various services.

Internet users can easily amend their personal data via the “personal account” interface.
